<p>Each bid shall be accompanied by the security referred to in the contract documents, the non-collusion declaration, the list of proposed subcontractors, and all additional documentation required by the Instructions to Bidders.</p>

<p>The District reserves the right to reject any or all bids or to waive any irregularities or informalities in any bids or in the bidding.</p>
<p><strong>If awarded, the District shall award each Project Contract to the lowest responsible bidder as determined from the base bid alone, unless otherwise set forth herein.</strong></p>
<p>The Director of Industrial Relations has determined the general prevailing rate of per diem wages in the locality in which this work is to be performed for each craft or type of worker needed to execute the contract, which will be awarded to the successful bidder, copies of which, are on file and, will be made available to any interested party upon request at Southwestern Community College. It shall be mandatory upon the Contractor to whom the contract is awarded, and upon any subcontractor under him, to pay not less than the said specified rates to all workers employed by them in the execution of the contract.</p>
<p><strong>Minority, women, and disabled veteran contractors are encouraged to submit bids. This bid is subject to Disabled Veteran Business Enterprise requirements.</strong></p>
<p><strong> </strong><strong>LABOR COMPLIANCE MONITORING: This project is subject to labor compliance oversight by the Department of Industrial Relations, Division of Labor Standards Enforcement, Compliance Monitoring Unit (CMU). The successful bidder must comply with the CMU requirements under Section 1771.3 of the Labor Code and Subchapter 4.5 of Chapter 8 of Title 8 of the California Code of Regulations. In bidding on this project, it shall be the bidder&#8217;s sole responsibility to evaluate and include the cost of complying with all labor compliance requirements under this contract and applicable law in the contract amount.  Additional information regarding the CMU requirements, including the submission of certified payroll reports and the posting of notices, is set forth in the General Conditions.</strong></p>
<p>Each bidder shall be a licensed contractor pursuant to the California Business and Professions Code Section 7028.15 and Public Contract Code Section 3300, and shall be licensed in the following classification as required by the scope of work required in the above called out Bid Packages listing. Any bidder not licensed at the time of the bid opening will be rejected as non-responsive. Estimated Trade Package values are listed above.</p>
<p>Contractors shall have been in business under the same name and California contractor’s license for a minimum of three (3) continuous years prior to bid opening.</p>

<p>The contract for this project will be awarded upon the lowest responsive and responsible Base Bid price, without consideration of the prices on any Bid Alternate additive items.</p>
<p>At the time of award of the Base Bid Contract to the lowest responsible and responsive bidder for the Base Bid items, the City Council may also choose to award to that contractor, for the price listed in his bid, one or more of the Bid Alternates above.  Any Bid Alternates that are not awarded at the time of award of the Base Bid Contract may be awarded to the same Contractor, at the price in Contractor’s bid, for a period of 90 calendar days following the date given in the Notice to Proceed for the Base Bid Contract.  Following the expiration of the 90 calendar day period, City may rebid one or more of the Bid Alternates.  City Council maintains its sole discretion in determining which Bid Alternates, if any, to award, and whether to award them to the contractor awarded the Base Bid Contract or whether to bid the Bid Alternate(s) as separate projects.</p>
<p><strong>OBTAINING BID PACKAGE:</strong> Bid Packages may be obtained after April 12, 2012, at the Parks and Recreation front service counter at505 South Vulcan Ave., Encinitas, CA92024, at a non-refundable cost of $375.00 per set.  Prospective Bidders may call (760) 633-2740 with any questions about obtaining a bid package.  Due to the large size of the bid package, requests for mailing bid packages cannot be accommodated.  As an alternative, prospective bidders may send a courier to pick up the bid package, at the bidder’s cost.  The City is closed alternate Fridays.</p>
<p>A preview CD-ROM is available to prospective bidders at the time and address listed in the paragraph above for a non-refundable cost of $20.00 per CD-ROM.  The CD-ROM contains digital preview versions of the materials included in the bid package but no prints and no addenda.  Prospective bidders who have obtained the preview CD-ROM <strong><span style="text-decoration: underline;">must</span></strong> obtain a standard printed bid package for bidding purposes.  The City makes no representation regarding the accuracy or completeness of the documents presented on the CD-ROM, and bids submitted on the preview forms included in the CD-ROM will not be accepted.  Prospective bidders may request to receive copies of the preview CD-ROM by mail by calling (760) 633-2740.  The cost for mailing the preview CD-ROM is an additional $5.00 within the state of California; cost of mailing outside of California will be higher.</p>
<p>In compliance with California Contract Code, Section 20103.7, electronic copies will be made available to contractor plan room service upon request. The City makes no representation regarding the accuracy of Contract Documents received from third party plan rooms and recommends that any contractor interested in bidding the project obtain a bid package from the City.</p>

<p><strong>LICENSE:</strong>  In order to bid this project, the Contractor must have at the time of bid award a valid State ofCalifornia Class A license in good standing.  Certain specialty licenses may be required of certain work as set forth in the Contract Documents.  The Contractor is responsible to ensure that all proper licenses are maintained.  No bid will be awarded to a contractor who is not licensed in accordance with these requirements or the provisions of Chapter 9, Division 3 of the Business and Professions Code.</p>
<p>In addition, because impacted soil onsite contained elevated concentrations of organochlorine pesticides, the Contractor or Subcontractor performing grading, excavation, or other work who may potentially come into contact with pesticide-bearing soil shall have a HAZ-endorsed license and shall use 40-hour Hazardous Waste Emergency Response and Operations (HAZWOPER) trained operators and field staff.  The Contractor shall refer to the Soils Reuse Plan and Community Health and Safety Plan in the Contract Documents and shall prepare a Worker Health and Safety Plan as required by the County DEH and these Contract Documents.</p>
<p>City shall have the right to request, and Bidder shall provide within 5 calendar days of the request, evidence satisfactory to City of all valid license(s) currently held by that Bidder and Bidder’s Subcontractors required by these Contract Documents.</p>
<p><strong>BOND AND BID SECURITY</strong>: Bid Security shall accompany the bid in the form of a certified or cashier&#8217;s check, or a Bid Bond for ten percent (10%) of the total bid amount.  Additional information on bid security requirements can be found in the project Specifications included with the Bid Package.  All bonds shall be issued by an admitted carrier qualified to do business in California.</p>
<p><strong>MANDATORY PRE BID MEETING:</strong> A MANDATORY pre-bid meeting and site visit will be held at 10 a.m. on Wednesday, May 9, 2012. The meeting will convene at425 Santa Fe Dr. (behind the Von’s shopping center at the Park site)Encinitas, California. All Contractors who intend to bid on this project MUST sign in and be in attendance of the entire meeting and site visit in order to be eligible to bid.  The pre-bid meeting is informational only. The bidder shall not rely upon any representations made at the meeting or site visit in preparing its bid, but shall rather rely solely upon the written Contract Documents and any contract addenda issued prior to bid opening.</p>
<p><strong>WAGE RATES:</strong> This is a prevailing wage project and prevailing wage rates for this locality and project as determined by the Director of the California Department of Industrial Relations apply, pursuant to labor code section 1770, et. Seq.  A schedule of prevailing wage rates may be found on the internet at <a href="http://www.dir.ca.gov/dlse/dlsepublicworks.html">http://www.dir.ca.gov/dlse/dlsepublicworks.html</a> .  A copy of the prevailing wage rates shall be posted on the job site by the Contractor.  A schedule of prevailing wage rates is available for review at the City’s offices.  Questions pertaining to State predetermined wage rates should be directed to the State department of Industrial Relations website at <a href="http://www.dir.gov/">www.dir.gov</a> .  The successful bidder shall be required to pay at least the wage rates set forth in that schedule.  The prime contractor shall be responsible for ensuring compliance with all applicable provisions of the Labor Code including, but not limited to, Section 1777.5.</p>
<p><strong>RIGHT TO REJECT ALL BIDS</strong>:  The City requires responsible and responsive bidders.  All Base Bids shall remain valid for a period of 90 calendar days from the date of bid opening.  The City reserves the right to reject all bids at its sole discretion and to waive any immaterial irregularities or informalities in the bids received. Withdrawal of bids shall not be permitted for a period of 90 calendar days after the bid opening.</p>
<p>The Bid Alternate prices listed in the lowest responsible and responsive bidder’s bid shall remain valid for a period of 90 calendar days following the date given in the Notice to Proceed for the Base Bid Contract.</p>

<strong> Notice of Public Hearings for Proposed Emergency Solutions Grant (ESG)</strong><br />
<strong> Substantial Amendment of the FY2012 Annual Action Plan</strong></p>
<p style="text-align: left;">The United States Department of Housing and Urban Development (HUD) has awarded the City of San Diego a supplemental allocation of $372,022 of Emergency Solutions Grant (formerly: Emergency Shelter Grant), or ESG, funds for FFY2011, pursuant to the Homeless Emergency Assistance and Rapid Transition to Housing (HEARTH) Act of 2009. HUD’s priority uses for the supplemental funds are homelessness prevention and rapid re-housing.</p>
<p style="text-align: left;">Because this is a supplemental allocation of federal funds, the City, as an Entitlement Grantee, is required to submit a substantial amendment to its FY12 Annual Action Plan to HUD by May 15, 2012 in order to receive the allocation. Los fondos HOME pueden ser utilizados “para proveer incentivos para desarrollar y apoyar vivienda de renta accesible y propietarios de vivienda a través de la adquisición, construcción nueva, reconstrucción o rehabilitación con servicios públicos apropiados, incluyendo la real adquisición de propiedad, mejoramiento del terreno, converción, demolición y otros gastos. También puede ser utilizado para proveer por el pago de costos razonables administrativos y de planeación, y de proveer por el pago de gastos de operación de organizaciones de desarrollo de vivienda de la comunidad (CHDO’s) &#8211; 24 cfr 92.205(a)”. Toda jurisdicción participante debe apartar el 15% de su ayuda social para CHDO’s.</p>
<p style="text-align: left;">El Plan de Acción Anual es el documento que provee detalles de los proyectos y programas que serán financiados a través de fondos CDBG y HOME para el año fiscal 2012-13.
